By creating an account on or using ListingHammer, you agree to these terms. If you do not agree, do not use the service.

Eligibility

Bidders must be currently licensed real-estate brokers or agents in good standing in the markets they bid on. Investors, wholesalers, and lead resellers are not permitted on the platform.

Auction rules

Bids submitted are binding once the auction window closes. Winning bids are charged immediately. Refunds for bad-data conditions (disconnected phone, off-market listing, duplicate record, wholesaler contact) are processed within 24 hours. Collusion, shill bidding, and account-sharing result in permanent suspension and a clawback of contested wins.

Outreach compliance

Winners are responsible for TCPA, CAN-SPAM, and DNC compliance on all outreach to leads acquired through the platform. ListingHammer provides per-contact opt-out tokens and DNC screening as a service; the legal obligation rests with the contacting party.

Limitations

The service is provided "as is." We do not guarantee specific win rates, conversion rates, or commission outcomes. Maximum liability is capped at the bidder's trailing 90 days of paid auction wins.
