ListingHammer ("we," "us") operates a live auction marketplace for licensed real-estate brokers and agents to bid on exclusive contact rights to expired, withdrawn, and cancelled MLS listings. This policy explains what information we collect from our bidders and from the homeowners whose listings appear on the auction floor, how we use it, and your rights regarding it.
From bidders: name, email, brokerage affiliation, state license number, IP address, billing details, and bidding behavior. From homeowners whose listings are auctioned: name, mailing address, phone number, and email -- sourced from public MLS records and licensed skip-trace providers.
To verify bidder licenses, run the auction floor, transfer exclusive contact rights to winners, comply with TCPA and DNC requirements, and provide opt-out mechanisms to homeowners.
Homeowner contact information is transferred only to the winning bidder of each auction, and only after the bid clears. We do not sell bidder data. Subprocessors (Stripe, Twilio, SendGrid, Cloudflare) handle payments, messaging, email, and infrastructure under contract.
Homeowners may opt out of all outreach via the per-record opt-out link supplied with every winning bid. Bidders may delete their accounts at any time; auction history is retained for compliance purposes for seven years per industry standard.
